DEXiWare Terms & Condition of Use

This Privacy Policy is declared by the Jožef Stefan Institute (Jamova 39, 1000 Ljubljana, Slovenia).

Definitions

“we/us” means the Jožef Stefan Institute indicated above;

“system” means the DEXiWare web-based tool;

“you” means a user of the system;

General

By accessing this web application, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

Any violations will be reported to the competent EU authorities.

Access

The system may only be accessed and used on a device owned or controlled by you and running the relevant operating system for which, the system concerned was designed, so you must make sure you have a compatible device which meets all the necessary technical specifications to enable you to use the system you wish to access.

You will be assumed to have obtained permission from the owner of any device that is controlled, but not owned, by you to access the system from that device. You accept responsibility, in accordance with these terms and conditions, for all access to, and use of, the system by you on any device, whether or not it is owned by you.

You acknowledge that the mobile service provider for any mobile device on which you access or use the system may charge for internet access (including mobile data usage) on that device.

We cannot and do not guarantee the continuous, uninterrupted or error-free operability of the system or that it will respond at a certain speed (since this depends on a number of factors outside our control).

Intellectual property rights

All intellectual property rights in the system and its content (including source code, text, graphics, software, photographs and other images, videos, sound, trademarks and logos), other than User Content, are owned by us or our licensors. Except as expressly set out here, nothing in these terms and conditions gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by accessing the system or any content from the system.

The system may contain code, commonly referred to as open source software, which is distributed under any of the many known variations of open source license terms, including terms which allow the free distribution and modification of the relevant software’s source code and/or which require all distributors to make such source code freely available upon request, including any contributions or modifications made by such distributor (collectively, Open Source Software). Please note that, to the extent that the system contains any Open Source Software, you are only permitted to use that element under the relevant license terms of the applicable third-party licensor (Open Source License Terms) and not under these terms and conditions, and you accept and agree to be bound by such Open Source License Terms.

Permission

The system is made available and accessible for personal use, research or teaching. Commercial use is not allowed “as is”, except if the acquired knowledge by using the system is offered as part of commercial packages/services by commercial bodies.

Modification, distribution and reproduction is possible only with our prior consent. In case of reproduction of the contents you need to cite the source.

The source code of the system is protected as our intellectual property and as such its distribution or modification is not permitted without our prior consent.

Liability & Warranty

We do not warrant that the system will operate error free or that the web access, the server, or the content is free of computer viruses or similar contamination or destructive features. If your use of the site or the content results in the need for servicing or replacing equipment or data, we shall not be responsible for those costs.

The system and the content are provided on an “as is” and “as available” basis without any warranties of any kind. We hereby disclaim all warranties, including, but not limited to, the warranty of system’s results, recommendations, and their applicability on a farm/field. Furthermore, we disclaim all technical warranties including, but not limited to, the warranty of merchantability, and non-infringement of third parties’ rights.

In no event shall we be liable for any damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from implementation of system’s results and recommendations) resulting from the use of inability to use the system and its content.
